Terms of Use

This document constitutes a legal agreement (hereinafter the “Agreement”) between you (hereinafter “You” or “User”) and BirApps Studio (hereinafter “BirApps Studio” or “We”) governing the download, installation, and use of the mobile application (hereinafter the “Mobile Application”).

By downloading, installing, or using the Mobile Application, You confirm that You have read, understood, and agree to be bound by this Agreement.

1. Definitions

• Effective Date: The date on which You first download, install, or use the Mobile Application.
• User Content: Any photos, videos, text, audio, or other materials created, uploaded, or generated by You within the Mobile Application.
• Device: Your mobile phone, tablet, or other compatible device.
• Services: All features and functionality provided through the Mobile Application.
• Subscription: A paid plan that grants access to premium features with optional automatic renewal.
• Subscription Term: The duration of an active Subscription.
• Subscription Fees: The fees payable for a Subscription.
• Free Services: Limited features available without payment.
• In-App Purchases: Optional purchases of digital content or features within the Mobile Application.

2. Services

BirApps Studio grants You a limited, non-exclusive, non-transferable, revocable license to use the Mobile Application and Services for personal, non-commercial purposes. Free Services are provided on an “as is” basis and may be subject to technical limitations or changes at BirApps Studio’s discretion.

3. Authorization and Account

To use certain features of the Mobile Application, You may be required to register through the respective app store (Apple App Store or Google Play). You are responsible for maintaining the confidentiality of Your account credentials and for all activities that occur under Your account. BirApps Studio processes Your personal data in accordance with our Privacy Policy.

4. User Content

You retain ownership of Your User Content. By uploading or creating User Content, You grant BirApps Studio a worldwide, royalty-free, non-exclusive license to store, process, and display such content as necessary to provide the Services. You are solely responsible for the legality, accuracy, and appropriateness of Your User Content. BirApps Studio is not liable for any loss or damage to User Content.

5. User Restrictions

You agree not to:

• Copy, modify, distribute, reverse engineer, or create derivative works of the Mobile Application;
• Use the Mobile Application for any illegal, harmful, or unauthorized purpose;
• Interfere with the operation of the Services or attempt to gain unauthorized access.

6. Obligations

BirApps Studio will provide the Services with reasonable skill and care. You agree to pay any applicable Subscription Fees and In-App Purchases promptly and to comply with all applicable laws and this Agreement.

7. Term and Termination

This Agreement takes effect on the Effective Date and continues until terminated. Either party may terminate the Agreement at any time. Upon termination, Your access to the Services will cease immediately, and any active Subscriptions will not be refunded unless required by law.

8. Fees and Payment

Certain features require payment of Subscription Fees or In-App Purchases. Payments are processed through the respective app store, and You agree to the terms of that platform. Subscription Fees are non-refundable except as required by applicable law.

9. Liability and Disclaimer

The Mobile Application and Services are provided “as is” and “as available” without warranties of any kind. BirApps Studio disclaims all liability for indirect, incidental, or consequential damages. BirApps Studio’s total liability shall not exceed the amount You paid (if any) in the twelve months preceding the claim.

10. Governing Law

This Agreement shall be governed by the laws of the jurisdiction in which BirApps Studio is established, without regard to conflict of law principles.

11. Miscellaneous

• The parties are independent contractors.
• BirApps Studio may suspend or interrupt Services for maintenance or technical reasons.
• This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements.
• BirApps Studio reserves the right to modify this Agreement at any time. Continued use of the Mobile Application after changes constitutes acceptance of the updated terms.
